1. Who we are
These General Terms and Conditions (“Terms”) govern your use of the Certificatory platform at certificatory.com and any related services (the “Service”). The Service is operated by BIG DREAMS GROUP, UIC 206986388, with registered office at Skobelev 42, Sofia, Bulgaria, contact email [email protected](“we”, “us”, “Certificatory”).
The Terms are drafted under Bulgarian law and are binding on every user of the Service. By creating an account or completing a purchase, you confirm that you have read, understood and accepted them.
2. The Service
Certificatory lets event organisers design certificate templates, generate personalised PDF certificates and distribute them to attendees through an embeddable claim widget. Access is granted on a per-event basis according to the tier you select.
We may update or improve the Service at any time. We will not reduce material functionality you have already paid for without reasonable notice and, where appropriate, a pro-rated refund.
3. Accounts
You must provide accurate registration details and keep your password confidential. You are responsible for every action taken through your account. You must be at least 18 years old and legally capable of entering into contracts.
You may close your account at any time from the Account page or by contacting us. We may suspend or terminate accounts that breach these Terms or applicable law, with notice where reasonable.
You must verify your email address before creating paid events or processing any payment. This protects us and other users from typo-addresses and abuse. Verification links are valid for 24 hours and can be re-sent from your Account page.
4. Pricing and payment
Prices are listed on the pricing page and are payable in euro (EUR). VAT, where applicable under Bulgarian or EU tax law (Bulgarian Value Added Tax Act - ЗДДС), may be calculated at checkout and, where required, shown on the invoice. If you are a VAT-registered business outside Bulgaria, provide your VAT ID at checkout so reverse-charge can be applied where applicable.
Payment is processed by an external payment processor. We do not store full card details on our servers. Your purchase becomes effective once the payment processor confirms the transaction and your event is activated in your dashboard.
5. Consumer right of withdrawal
If you purchase as a consumer under Bulgarian law, you normally have a 14-day right to withdraw from a distance contract under Art. 50 of the Bulgarian Consumer Protection Act (ЗЗП). However, under Art. 57, point 13 of that Act, the right of withdrawal does not apply to the supply of digital content not on a tangible medium where performance has begun with your express prior consent and acknowledgement that you thereby lose your withdrawal right.
When you activate an event and begin using the editor, generate certificates or copy the embed snippet, we treat that as your express consent for performance to begin immediately and as acknowledgement that the right of withdrawal is lost from that moment. Until that moment, you may request a refund by emailing [email protected].
6. Acceptable use
You agree not to:
- upload unlawful, infringing, defamatory or obscene material;
- use the Service to issue fraudulent or deceptive certificates;
- reverse-engineer, scrape at scale or attempt to breach security measures;
- use the Service to send unsolicited commercial communications.
7. Your content
You retain all rights in the templates, logos, text and attendee data you upload (“Your Content”). You grant us a limited, non-exclusive licence to host, process and render Your Content solely to provide the Service. You represent that you have all necessary rights and consents to upload it.
We will delete Your Content and generated certificates when you delete the corresponding event, subject to a short grace period for backups.
8. Availability and limits
We aim for high availability but do not guarantee uninterrupted service. The Service is provided “as is”. We exclude all warranties to the fullest extent permitted by Bulgarian law.
To the extent permitted by law, our total liability for any claim in connection with the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, lost profits or lost data. Nothing in these Terms limits liability for gross negligence, wilful misconduct or death or personal injury caused by our negligence.
9. Complaints
If you are unhappy with the Service, please email us at [email protected]. We aim to respond within 14 days. Consumers may also refer a dispute to the Bulgarian Commission for Consumer Protection (Комисия за защита на потребителите - kzp.bg) or to the European Commission’s online dispute-resolution platform at ec.europa.eu/consumers/odr.
10. Personal data
We process personal data as described in our Privacy Policy. By using the Service you acknowledge that you have read it.
11. Changes
We may update these Terms. The “Last updated” date at the top indicates when they were last changed. For material changes we will notify active users by email at least 14 days before the changes take effect. Continued use after the effective date counts as acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria. Any dispute arising from or in connection with the Service will be brought before the competent court in Sofia, Bulgaria, unless mandatory consumer-protection rules give you the right to bring proceedings before a different court.
